This User Agreement ("Agreement") has entered into force at the moment of digital approval between Simur Teknoloji Anonim Şirketi, residing at Ahmet Yesevi, Kerem Sk. No:9, 34903 Pendik/İstanbul ("Simur Teknoloji"), and the person or entity ("User") who registers to and/or purchases services at https://kaf.simur.org ("Platform").
The subject of this Agreement is to determine the terms of use, subscription models, and the rights and obligations of the parties regarding KAF-AI ("Service"), an AI-powered closed-loop SEO (Search Engine Optimization) assistant provided by Simur Teknoloji, by the User.
3.1. KAF-AI is an assistant that performs technical SEO analyses for websites, provides recommendations, and provides automation through specific integrations. Simur Teknoloji does not provide any explicit guarantee that the User's website ranking in search engines will increase, traffic will rise, or commercial profit will be achieved as a result of using KAF-AI. Simur Teknoloji cannot be held responsible for ranking losses, traffic decreases, or indexing issues that may occur due to the nature of search engine algorithms.
3.2. WordPress Integration (KAF WP Connector): Technical interventions (code edits, plugin updates, etc.) performed automatically on the User's website through the KAF WP Connector plugin are entirely at the User's own risk and approval. Simur Teknoloji is in no way responsible for any theme conflicts, data loss, crashes, or access interruptions that may occur on the website during these automation processes. The User accepts that the responsibility for regular backups lies with them.
3.3. KAF-AI Pixel Integration: By adding the "KAF-AI Pixel" code provided by the Platform to the User's website, remote interventions and SEO edits can be sent to the site via the Platform. The integration of this code into the site and the execution of remotely sent edits are entirely at the User's own initiative and responsibility. Simur Teknoloji cannot be held responsible for any conflicts with other scripts on the site, performance issues, security vulnerabilities, or design distortions caused by the use of the KAF-AI Pixel code.
3.4. Uptime Monitoring and API Connections: Uptime (availability) ping durations provided via the Platform vary according to the subscription package selected by the User. Simur Teknoloji cannot be held responsible for interruptions, limit exceedances, or data delays originating from the relevant provider encountered in API connections made with Google Search Console, WordPress, and other third-party services to be added.
4.1. Subscription Model: The Platform offers flexible subscription models, including free ("Egg") packages, fixed-fee (Minotau, Pegasus, Dragon, Phoenix) packages, and a "Custom Package" where the User can determine limits and capacities according to their own specific needs.
4.2. AI Credit System: Within the Platform, there is an "AI Credit" system to be used for processes such as AI-powered content production, AI-powered backlink acquisition, and SEO edits. (Current in-platform rate: 1 AI Credit = 1 TRY). Purchased AI credits are in the status of digital services that are immediately performed and consumable. Therefore, purchased AI credits, whether used or not, absolutely cannot be converted to cash, refunded, or transferred to another account.
4.3. Exchange Rate and Pricing: All package pricing on the Platform is based on US Dollars (USD). However, collection processes are carried out in Turkish Lira (TRY) based on the instant exchange rate valid on the day the payment is made. Monthly/annual collection amounts in TRY may vary instantly due to exchange rate fluctuations.
4.4. Payment Infrastructure and Card Storage: Simur Teknoloji absolutely does not store the User's credit card or debit card information on its own servers. All payment transactions and card storage processes are managed by the BDDK-licensed "Moka" payment infrastructure.
4.5. Automatic Renewal: Paid subscriptions are automatically renewed by being charged via the selected payment method in each billing period (monthly, 6-month, or annual) unless canceled by the User via the Platform.
5.1. Non-Refundability: Since the service provided by KAF-AI is in the nature of an immediately performed digital service and software automation (pursuant to the Right of Withdrawal Exceptions in the Regulation on Distance Contracts related to Law No. 6502), no refunds are made under any circumstances in the system.
5.2. Subscription Cancellation: The User has the right to cancel their subscription at any time. When the cancellation process is completed, no fee will be charged from the User's credit card or other payment methods for the next period. However, no partial or full refund of the fee paid for the current period will be made. The User continues to benefit from the package features until the end of the period for which they have paid.
All software, design, algorithms, logos, and the "KAF-AI" brand of the Platform belong entirely to Simur Teknoloji. The User may not copy, reverse engineer, or sell this software for commercial purposes.
The laws of the Republic of Türkiye shall apply to any disputes arising from the implementation and interpretation of this Agreement, and the place of resolution shall be the Istanbul (Anadolu) Courts and Execution Offices.
